RELEASE OF LIABILITY AGREEMENT

LIABILITY WAIVER

Buyer must be 18 years of age or older to purchase a pocket
bike, motorcycle, ATV, or any other on or off road product.
I understand and am aware that purchasing & riding our
products is a HAZARDOUS activity and involves the risk of
injury to any and all parts of my body. Despite the risks, I
HEREBY AGREE TO FREELY AND EXPRESSLY ASSUME
and accept any and ALL RISK of injury or death to the user of
our products.

I understand that all riders should wear a DOT approved, full
face, motorcycle helmet, and all other available protective
gear such as chest protectors, knee pads, elbow pads, etc.
when using our products.

To the fullest extent allowed by law, I AGREE TO RELEASE
Ultimate Toyz, LLC, its agents, web site, officers,
employees, partners, successors and assigns, the
manufacturer, importer and distributor of the equipment FROM
ANY AND ALL LIABILITY and responsibility for injuries or damages to the user of this product, or any other person.
Also, I AGREE TO RELEASE, HOLD HARMLESS AND
INDEMNIFY Ultimate Toyz, LLC from any and all liability for
injuries or damages, whether it arises from the intended use,
or misuse, any NEGLIGENCE, or other cause regarding the
performance or use of our products.

This document is a legal binding contract which supersedes
any other agreements or representations by or between the
parties and is intended to provide a comprehensive release of
liability, but is not intended to assert any claims or defenses
which are prohibited by law. I understand and agree that this
agreement will be interpreted pursuant to the laws of the State
of Missouri. If any portion of this agreement is deemed
unenforceable, the remainder shall be given full force and
effect. I understand that this is legally binding on my heirs,
executers and assigns.

I understand that Ultimate Toyz, LLC products are subject
to all laws of the road and that many states and localities have
additional laws, which may specifically apply.
I understand that regular maintenance is required to keep
Ultimate Toyz, LLC products operating properly, that failure
to properly maintain it may make them unsafe. Regular
maintenance includes frequent inspection of all quick release
mechanisms, wheel retention devices, welds, nuts, bolts, cap
screws, handlebars, brakes, frame and all other structural and
working parts.

THIS IS A RELEASE OF LIABILITY. I UNDERSTAND AND
AGREE WITH THE TERMS OF THIS ASSUMPTION OF
RISK, INDEMNIFICATION AND RELEASE OF LIABILITY.

This release is for this and all future sales.
